Tracy City Council approved an ordinance allowing Safe and Sane fireworks in May 2011 (TMC Chapter 3.04). Only 501(c) nonprofit organizations may apply for sales permits, and the maximum number issued per year is capped at 1 permit for each 10,000 population. Safe and Sane fireworks must bear the official seal of the California State Fire Marshal's Office. Fireworks without the State Fire Marshal seal are classified as dangerous fireworks and are illegal throughout the South County Fire Authority's jurisdictional area, which includes Tracy. Applications for the annual lottery are accepted November 1 through early December each year (2024 deadline was December 5 at 6:00 PM).
