Hudson, NH Fire Regulations: Outdoor Burning (2026)

Hudson Town Code § 210-1, adopted by the 1975 Annual Town Meeting, requires any person, firm or corporation to obtain a permit from the Fire Chief or a designee before kindling, or causing to be kindled, any outside fire, regardless of the time of day, year or weather conditions. That blanket language leaves no seasonal or small-fire carve-out in the Town's own text: the permit requirement applies to every outdoor fire the Fire Department has authority over. Enforcement runs through § 210-2, which ties violations to RSA Chapter 227-L, the state's forest-fire statute: a person who kindles a fire without the required permit is guilty of a violation and must also pay any expenses the Town incurs extinguishing a fire that results from the unpermitted burn.

The Town Meeting separately authorized the Fire Chief, in Article III (Article 30 of the 1977 Annual Town Meeting), to issue fire burning permits whenever conditions warrant, so long as the practice does not conflict with the state statute then numbered RSA 224. 4, meaning any future change to outdoor-burning rules would appear as a recorded amendment to this chapter rather than a standalone bylaw.
