Even inside that window, the work still can't exceed the underlying continuous and impulsive sound-level limits set in § 249-4B and § 249-4C for the surrounding land use, so the schedule doesn't excuse exceeding the decibel caps that would otherwise apply. Government operations, including contracted government projects, are exempt from the schedule altogether. Every piece of construction equipment must also carry a properly installed and maintained silencing system as originally furnished by its manufacturer, and unmuffled exhaust or intake systems on either mobile or stationary equipment are barred outright under § 249-4I(2).
