Town Code Sec. 16-48, in Chapter 16's Article III on fire prevention, states it shall be unlawful to burn any trash or to have any bonfire within the corporate limits without first obtaining a permit from the fire chief, or in his absence, the police chief, or their lawful assistants. That puts the permitting authority squarely with the fire department chain of command rather than a general zoning or code-enforcement office, reflecting the article's broader focus on fire-safety gatekeeping: the same article makes it unlawful to give a false fire alarm (Sec.

16-39), to tamper with a hydrant or waterline without authorization from the utilities superintendent, public works director, or town administrator (Sec. 16-40), to drive over a fire hose without the fire chief's permission (Sec. 16-41), or to interfere with firefighters answering a call (Sec. 16-42). Because Sec. 16-48 sits in that same run of unlawful-without-authorization provisions, town fire officials treat the trash-and-bonfire permit as a genuine prerequisite, not a formality: a resident who wants to burn yard debris, hold a bonfire for an event, or dispose of trash by burning must first secure the fire chief's sign-off.

The Fire Prevention chapter also separately regulates fireworks under Article IV starting at Sec. 16-73, which is a distinct permit track from the trash-and-bonfire rule in Sec. 16-48.
