Weston, FL Fire Regulations: Outdoor Burning (2026)

Section 52.16(A) prohibits any Person from igniting, causing to be ignited, permitting to be ignited, allowing, burning or maintaining any outdoor fire within the City of Weston, with no distinction drawn between a small debris pile and a large bonfire. Subsection 52.16(B) then carves out the Code's only exceptions, and only when conducted or used in a safe and responsible manner: noncommercial outdoor food preparation such as grilling, tiki torches, patio fireplaces, prescribed burns carried out by the City Fire Department or another governmental agency with legal authority to conduct them, and training exercises run by the City Fire Department itself.

Every other form of open burning, including yard-waste burning, bonfires, and burn barrels, remains flatly prohibited regardless of lot size or setback from a neighboring property, since the ordinance grants no permit path for a private resident to obtain an exception outside the five listed categories. The section traces to Ordinance 2010-12, adopted October 4, 2010, and was amended by Ordinance 2024-09 on May 20, 2024, which updated the current exemption list. Because Chapter 52 does not set an independent fine for open burning, a violation is punished under the Code's general penalty at Section 2.99: up to $1,000 per day for a first violation, up to $5,000 per day for a repeat violation, and up to $15,000 per violation if the violation is deemed irreparable or irreversible, or by imprisonment for up to 60 days, with each day the fire is maintained treated as a separate offense.
