Cupertino amends California Fire Code Section 6104.2 through Municipal Code 16.40.320 to cap the aggregate capacity of any one LPG installation at a water capacity of 2,000 gallons in all residential or congested commercial areas, as determined by the fire code official. Exceptions allow LPG for industrial operations where natural gas is not a viable substitute, and portable containers for temporary heating and cooking if handled per the Fire Code. Commercial cylinder-refueling facilities may be approved case by case. In the Wildland-Urban Interface Fire Area, adopted Chapter 49 also requires flammable vegetation cleared at least 10 feet around LPG tanks. Typical 20-pound barbecue cylinders fall well within these limits when stored outdoors and upright.
Exceeding the 2,000-gallon residential limit, improper cylinder storage, or failing to keep vegetation clear around a tank in the WUI can be cited by the Santa Clara County Fire Department. Larger tanks and installations require fire department permits and inspection.
