All fireworks, including state-approved Safe and Sane types, are banned in Cupertino. The Santa Clara County Fire Department enforces the prohibition citywide, consistent with a countywide ban across nearly all Santa Clara County cities. Only licensed public displays are allowed.
Cupertino amends California Fire Code Section 5601.1.3 through Municipal Code 16.40.240 to prohibit the possession, manufacture, storage, sale, handling, and use of all fireworks, including those classified as Safe and Sane by the California State Fire Marshal. In the locally adopted Wildland-Urban Interface Fire Area, CFC Section 4910.1 separately bars fireworks from being used or possessed. The only exceptions are licensed public fireworks displays permitted under CFC Section 5608 and pyrotechnics for entertainment productions under Title 19 and Health and Safety Code Division 11. The Santa Clara County Fire Department serves as the fire code official for Cupertino.
