Haverhill, MA Fire Regulations: Propane Storage (2026)

City Code § 150-2 adopts, as the City's Fire Prevention Code, the provisions of MGL c. 148 and the Board of Fire Prevention Regulations found in 527 CMR, chapter 7 (Fire Resistant Materials and Construction) and chapter 9 (Fire Protection Systems) of the Massachusetts Building Code (780 CMR), incorporating them as fully as if printed in the city ordinance itself. Section 150-3 establishes the Bureau of Fire Prevention inside the Fire Department, under the Chief of the Fire Department, to enforce that adopted code, and lets penalties be pursued through the non-criminal disposition process under MGL c.

40, § 21D and MGL c. 148A rather than only through criminal court. For bulk liquefied petroleum gas specifically, § 150-5 does not set a numeric gallon limit in the ordinance text; instead it establishes that the district limits referenced in Section 21.6A of the state Fire Prevention Code, the areas where bulk LP-gas storage is restricted, are determined by the City's Zoning Code together with the judgment of the Fire Marshal. That means a homeowner or business asking where and how much propane can be stored in bulk must check both the zoning district the property sits in and get a case-specific determination from the Fire Marshal's office, rather than relying on one fixed number printed in the chapter.

The same case-by-case approach applies under § 150-4 to aboveground flammable-liquid tanks and new bulk flammable-liquid plants, which the ordinance restricts by the identical formula of zoning plus Fire Marshal judgment.
