Summary

Smoke detectors are required in every residential dwelling, apartment, guestroom, condominium, and hotel or motel room in Santa Monica. Additional smoke detectors must be installed when remodeling a home beyond certain thresholds, and sellers must certify detectors are installed before a property sale.

§ 8.44.100. Smoke detectors--Existing residential occupancies.

(a) General. In every existing apartment, dwelling unit, guestroom, one- or two-family dwelling or condominium, hotel or motel room, smoke detectors shall be installed in accordance with the provisions of this Section.

(b) Existing Group R Occupancies. On or before July 1, 2001 approved and listed smoke detectors, which may be battery-powered, shall be installed and located in accordance with the California Fire Code.

(c) Residential Occupancy Remodels. Approved and listed smoke detectors, which meet the provisions of the California Building Code, shall be installed when any of the following occurs:

(1) Addition of a story which increases total floor area by more thirty-three and one-third percent; or

(2) More than fifty percent of the existing roof structure is removed; or

(3) The floor area of an existing residence with a floor area of one thousand square feet or less increases more than seventy-five percent; or

(4) The floor area of an existing residence with a floor area of more than one thousand square feet increases more than fifty percent.

(d) Transfer of Property. Prior to the sale or exchange of residential buildings subject to Chapter 9.08 of this Municipal Code, the seller shall certify, on the report of residential building record, that approved and listed smoke detectors have been installed.

Full Breakdown

All existing residential occupancies must have approved and listed smoke detectors located per the California Fire Code. Battery-powered detectors are allowed. When remodeling, detectors must be added if: a story is added that increases total floor area by more than 33%; more than 50% of the existing roof structure is removed; the floor area of a home 1,000 sf or less increases by more than 75%; or the floor area of a home over 1,000 sf increases by more than 50%. Detectors must be tested and maintained annually, with new batteries installed annually; professional servicing every 5 years is required for multi-family buildings (owner-occupied single-family homes are exempt from written records). For hearing-impaired occupants, visual notification appliances meeting minimum candela ratings are required.

Violations & Fines

At transfer of property, the seller must certify smoke detectors are installed on the Report of Residential Building Record: without certification the sale may be at risk. Failure to maintain detectors can result in administrative fines and civil action. Multi-family owners must maintain and produce five-year maintenance records upon Fire Department request.
