All fireworks are illegal in Santa Monica, including California State Fire Marshal 'Safe and Sane' fireworks. Municipal Code Section 5601.1.3 prohibits the sale, possession, transport, use, and discharge of any fireworks. Violations are misdemeanors punishable by up to $1,000 fine and/or six months in jail.
Santa Monica Fire Code Section 5601.1.3 imposes a complete ban on all fireworks within city limits. No person shall possess, transport, sell, offer for sale, use, or discharge any fireworks, including those certified as 'Safe and Sane' by the California State Fire Marshal. This includes sparklers, firecrackers, Roman candles, bottle rockets, and all other pyrotechnic devices. Limited exceptions exist for: (1) aerial public fireworks displays approved by the City Council, (2) pyrotechnic special effects authorized under state law for motion picture, television, theatrical, or group entertainment productions, and (3) use or transportation of fireworks by state or federal authorities pursuant to law. The ban is enforced year-round, with heightened enforcement around July 4th and New Year's Eve. The Santa Monica Fire Department and Police Department jointly enforce the prohibition.
Possession or use of fireworks is a misdemeanor punishable by up to $1,000 fine and/or six months in jail. Fireworks may be confiscated without compensation. Starting a fire with fireworks may result in additional arson charges.
