Wicomico County, MD Fire Regulations: Smoke Detectors (2026)

Section 160-46C sets the conditions a basement must meet before it can be used as a habitable sleeping room in unincorporated Wicomico County, and smoke detection is one of six listed requirements. The basement floor and any below-grade walls must be waterproof and damp-proof; window area must meet the Code's minimum, or, where a window sits partly or wholly below grade, a properly drained window well of adequate size and depth must be provided; total openable window area must meet the ventilation minimum set in Section 160-78 unless another approved ventilation device is supplied; the basement ceiling must be finished with a normal ceiling covering; a fire extinguisher must be supplied in the basement area; and smoke detectors must be installed at the top of the basement stairway and in each habitable space within the basement.

The section also sets a clear-ceiling-height floor of six feet six inches for habitable basement space, with narrow exceptions for beams and girders and for laundry, study or recreation rooms in one- and two-family homes. This is the county's own textual smoke-detector mandate for basement sleeping areas; for smoke-detector requirements in the rest of a dwelling, Section 160-76 of the same chapter defers instead to the Annotated Code of Maryland's statewide smoke-alarm law. A basement converted to a bedroom without a working smoke detector at the stairway and in the sleeping space fails Section 160-46 outright, regardless of whether the rest of the home otherwise complies with the state smoke-alarm statute.
