Oakland, CA Fire Regulations: Wildfire Zones (2026)

CAL FIRE maps Fire Hazard Severity Zones (FHSZ) in both State Responsibility Areas and Local Responsibility Areas. Oakland is almost entirely within a Local Responsibility Area, and CAL FIRE's LRA maps designate a large portion of the Oakland Hills as Very High Fire Hazard Severity Zone (VHFHSZ), with additional High and Moderate zones extending further downslope. The VHFHSZ triggers several overlapping regulatory regimes. Public Resources Code §4291 requires 100 feet of defensible space around every structure. Building Code Chapter 7A requires ignition-resistant exterior construction — Class A roofs, ember-resistant vents, non-combustible siding options, tempered or multi-pane windows, and enclosed eaves — for new construction and substantial remodels. AB 38 (Gov. Code §51182) requires sellers of property in the zone to disclose the hazard, provide documentation of compliance with defensible space, and for homes built before 2010 to disclose specified retrofit items in the Natural Hazard Disclosure Statement. Oakland's Wildfire Prevention Assessment District levies a parcel tax in the zone to fund vegetation management, chipping days, and home hardening grants. The City also restricts certain vegetation (notably mature eucalyptus, Monterey pine, and acacia) and may require removal or replacement during new construction permits.
