The owner applies in writing to the Village Clerk on the Clerk's form (§ 161-4). The application is signed and dated by the owner or a corporate officer and lists each owner's name, address and telephone number. For each vehicle it attaches a current Erie County Department of Health certification of a successful health inspection of both the vehicle and the facility where the food is prepared, plus a fire inspection certification from within the prior 12 months. A self-powered vehicle also needs a valid insurance certificate, New York State Department of Motor Vehicles registration, and certificate of inspection. The owner signs a statement to indemnify and hold harmless the village and its officers and employees.
The fee and the renewal fee are $150 for the first vehicle and $50 for each additional vehicle under § 161-5, as amended 4-4-2022 by L.L. No. 2-2022. The Board of Trustees can waive the fee for an applicant who owns or operates a restaurant or other food facility in a building in the village, provided that business is operating and open to the public.
