Full Breakdown
Chapter 161 of the Village of Hamburg Code sorts mobile food vending by distance, district and clock. Section 161-8(A) bars vending within 100 feet of the primary entrance of a restaurant open to the public, unless the restaurant owner gives written permission first. Section 161-8(K) bars vending within 60 feet of an intersection of two or more public highways or roads, and § 161-8(H) bars operating from a site that contains a gasoline service.
The time limit depends on zoning. In the Central Business District, Commercial District, Professional Office District, Light Industrial District and Industrial District, a vendor cannot stay at a single location within a public right-of-way for more than three hours (§ 161-8(B)). In the Residential 1, Residential 2 and Residential 3 Zoning Districts the limit on a public right-of-way is 20 minutes (§ 161-8(C)). Two exceptions apply there: a block party approved by the Board of Trustees of the Village of Hamburg, where the limit is the duration of the block party, and a private catered event, where the limit is two hours or the § 161-8(M) hours, whichever is less. A private catered event is service limited to the owners, occupants and guests of a single- or two-family dwelling, school, club, church or one of the other buildings listed in § 161-2, with written permission from the owner or occupants.
Hours are fixed by § 161-8(M): no vending before 7:00 a.m. or after 11:00 p.m., and in the three residential districts no vending before 9:00 a.m. or after 8:00 p.m. A Board-approved block party is the one carve-out.
On the street itself, § 161-8(I) says vendors parked on the public right-of-way cannot dispense products from the street side of the vehicle, and § 161-8(J) says a self-powered vehicle cannot be operated in reverse to attempt or make a sale. Section 161-8(L) adds a 500-foot buffer around licensed fairs, carnivals, circuses, festivals, special events and civic events unless the vendor holds a permit from the Village Clerk. Signage must be permanently affixed to the vehicle, trash receptacles must be provided, and all trash must be removed from the site at the end of each daily operation.
Violations & Fines
Vending in a prohibited place or for too long is a violation of § 161-8. Under § 161-10(B) it is punishable by a minimum fine of $250 or imprisonment not to exceed 15 days, or both, except that Vehicle and Traffic Law violations are prosecuted as such. The Village of Hamburg Police Department and the Code Enforcement Officer enforce the chapter, issue appearance tickets, and can inspect a vehicle at any time (§ 161-9).
