Subdivision 2 of Article 6, Division V of the Unified Development Ordinance regulates mobile food vending. Section 6.1610 requires a mobile food vendor permit for all mobile food trucks and for mobile food carts located on a public sidewalk or in public or private parking spaces. An application fee is charged per the City's Schedule of Fees and Charges. The permit is non-transferable to another person or location. A cart set up in front of a store on private property, not occupying a parking space and not blocking traffic, is exempt, as are packaged-food delivery trucks. Food safety is a separate layer: carts and trucks must meet Jackson County Environmental Health Department standards and all health-code regulations.
Operating without the required mobile food vendor permit, or transferring one, violates the UDO. The Director may deny or revoke the permit; enforcement can order vending to stop, with appeal to the City Council within ten days.
