Chapter 5, Article 1 defines a 'Mobile Food Vendor' at § 5-101(g) as any business selling pre-packaged, prepared or on-site prepared food or edible goods from a self-propelled food truck, a non-motorized concession cart, or a trailer pulled by a motorized unit; a catering or delivery vehicle that only drops off pre-ordered food to a residence or business does not count. Because that definition sits inside the same article that covers peddlers, canvassers and solicitors, § 5-102(a) applies the same rule to mobile food vendors as to any peddler: operating without an 'un-revoked and unexpired license' issued by the City Clerk is unlawful.

Getting that license means filing the sworn application described in § 5-103, including the vendor's identification, vehicle information, a description of the food business, a photograph or fingerprints, and, specifically for food vendors, the Kansas Sales Tax number and Kansas Food Establishment license required by § 5-103(k) and (l). Under § 5-107(a), the license fee is $10 per day the vendor operates in the city, capped at $100 for any six-month stretch, or a $250 annual license valid through December 31 regardless of when it is issued.

Non-Miami-County residents must also pass the Chief of Police's investigation under §§ 5-104 to 5-106 and pay a $25 investigation fee before a license issues.
