First, a contractor or construction company may request a mobile vendor visit a job site, but the vendor may stay no more than 30 minutes per visit. Second, a commercial establishment with a valid local business tax receipt may invite a mobile vendor to serve its employees, again capped at 30 minutes per visit. Third, during Motorsports Complex race events, the licensing department may issue a Category No.
1 temporary license, for $198, to vend elsewhere in the city, or a Category No. m. Sec. 16-378(g) also requires compliance with Miami-Dade County Code Sec. 8A-276 vehicle-identification rules and Sec. 1's ban on sales near schools, and no license issues for use of a right-of-way unless police confirm it won't endanger traffic. Sec. 16-378(j) makes clear that mobile food dispensing vehicles (food trucks) on private property instead follow the separate rules of Article XVIII.
Violations & Fines
Operating as a mobile vendor in Homestead outside one of the Sec. 16-378 exceptions is punished under the Code's general penalty, Sec. 1-11: a fine of up to $500, up to 60 days in jail, or both, with each day of continued operation a separate offense. A Motorsports Complex license is also subject to immediate revocation under Sec. 16-378(3)(c) if the city manager, on advice from the police chief, finds a traffic or public safety hazard.
