Section 4.23.170(A) bars every sidewalk vendor from obstructing traffic flow in a way that violates the Americans with Disabilities Act, forces pedestrians into the street, or forces vehicles to veer from their ordinary path; from operating in the immediate vicinity of a permitted certified farmers' market or swap meet during its operating hours, as those terms are defined in Government Code Section 51036 et seq.; from operating within the immediate vicinity of an area designated for a temporary use or encroachment for the duration of that use; from operating without displaying any certificate or authorization required by the County of San Diego or any required State or local license; and from maintaining unsanitary conditions.

Section 4.23.170(B) adds rules specific to stationary sidewalk vendors, who additionally may not vend in any park with an exclusive concession agreement for food or merchandise sales, nor vend in any area zoned exclusively residential. Because Section 4.23.170 sits inside Chapter 4.23, sidewalk vendors are also solicitors for purposes of the chapter's core licensing rule in Section 4.23.030, meaning they need the same City business license, regulatory permit, and identification card as any other solicitor before setting up. Section 4.23.170(C) lets the Director of Engineering impose conditions on the regulatory permit to ensure compliance with this code, City ordinances, or other applicable law or regulation, giving the City case-by-case control over cart placement, hours, or health requirements at a given location.
