Oceanside, CA Food Trucks & Mobile Vendors: Sidewalk & Mobile Vending (2026)

Article V of Chapter 15, adopted under Ord. No. 19-OR0632-1 to implement Senate Bill 946, requires a sidewalk vendor to obtain a business license before selling food or merchandise from a pushcart, stand, rack or one's person on a public sidewalk (Sec. 64), after first securing a California Department of Tax and Fee Administration seller's permit plus any required County of San Diego health permits. The Sec. 65 application must disclose each vendor's identity, whether the operation is stationary or roaming, the vending devices used, a $1,000,000 liability insurance certificate naming the city as additional insured, and a description of the goods or food offered; the Financial Services Director has thirty business days to issue or deny the license.

Sec. 66 imposes operating conditions such as keeping a four-foot clear accessible path, banning amplified sound and open flames, and requiring the license be displayed on the cart or vendor's person at all times. Sec. 67 bans vending within 100 feet of Oceanside Beach, the Municipal Pier, Pier Plaza, the Oceanside Harbor and Harbor Village, and within 500 feet of a school or daycare during school hours, plus within 25 feet of fire hydrants, ATMs, driveways and crosswalks; stationary vendors additionally cannot operate in exclusively residential zones.

Enforcement runs through Sec. 68, which lets officers issue immediate administrative citations under Government Code § 51039 without prior warning, and Sec. 69 authorizes impounding a vendor's cart and goods, which are forfeited as abandoned if unclaimed after ninety days.
