Summary

For purposes of this chapter, a licensee shall be permitted to operate in a stationary location, provided the licensee shall be located in an area zoned for business, commercial, industrial or office-professional zone. No licensee shall be permitted to operate in a stationary location in an area zoned residential or on a lot used for residential use.
C. No licensee shall operate from a stationary location on private or public property without submitting to the Township Clerk written confirmation that the licensee has sent, via certified mail, a request for the express written permission of the property owner to operate on the owner’s property. A licensee may not operate from a stationary location on private or public property if the licensee is advised, in writing, that the property owner denies the licensee permission to operate from that location.

Under Township Code § 324-10, a peddler or mobile food vendor licensed under Chapter 324 may operate from a stationary spot only inside a zone classified business, commercial, industrial, or office-professional: never in a residential zone or on a residentially used lot. Even in an eligible zone, no licensee gets exclusive rights to a public-street spot, may block a driveway, fire lane, bus stop, or handicapped space, or may occupy more than two spaces in an improved parking lot; the enforcement officer decides in good faith whether an area is too congested. Operating on private or public property additionally requires sending the property owner a certified-mail request for written permission before setting up, and the licensee must obtain a license from the Township Clerk under § 324-2.
