Carlsbad, CA Food Trucks & Mobile Vendors: Vending Zones (2026)

SB 946, codified at Government Code § 51036 and following, flipped the default on sidewalk vending. It prohibits a local authority from regulating sidewalk vendors except in accordance with the act's own provisions, and it applies to a chartered or general law city, county, or city and county alike, so Carlsbad cannot simply prohibit the activity. The act also provides that a local authority need not adopt a new program if it already has one that substantially complies. Carlsbad's program is CMC Ch. 8.28, and it works by mapping where vending fits rather than deciding whether it is allowed at all.

Vending is permitted on sidewalks and in the public right of way. It is prohibited in alleys, on the beaches, on the piers, and in parking lots, which in a coastal city removes much of the highest-footfall ground from the map. Inside the areas that remain, several buffers apply at the same time. Stay at least 18 inches from the curb so the cart never overhangs the gutter or a passing vehicle. Stay 50 feet from another vendor. Stay 10 feet from outdoor dining, which protects the sidewalk seating in front of restaurants. Stay 500 feet from a permitted event or a farmers market.

Those distances interact, and the 500-foot event buffer is the one that catches people out. On a day when a farmers market is running, the 500-foot ring closes far more ground than the market's own footprint, and the 50-foot vendor spacing then rations whatever sidewalk is left. Scout the block before the event day rather than the morning of it.

Food trucks follow a separate pair of limits. Vending is restricted to roads posted at 25 mph or lower, which keeps trucks off the faster arterials, and a truck may hold a single spot for 60 minutes. Plan a route of legal stops rather than a single all-day location.
