Escondido City Council adopted a sidewalk vending ordinance consistent with California Senate Bill 946 (Gov Code Sections 51036 to 51039), which decriminalized sidewalk vending statewide and limits local regulation to objective health, safety, and welfare concerns. The ordinance takes effect January 1, 2027. Key rules: residential-area vending limited to 8:00 AM to 8:00 PM; vendors must maintain an 18-inch clearance from the curb and preserve ADA-accessible path of travel; vendors must hold a San Diego County Department of Environmental Health & Quality food permit (for food) plus an Escondido business license and sidewalk vending permit. Cities cannot require citizenship or collect immigration status. SB 946 mandates that first offenses be administrative infractions, not criminal β maximum $100 first, $200 second, $500 subsequent under state law.
