A.The following rules and regulations shall be complied with by each Itinerant Merchant. It shall be unlawful for any Itinerant Merchant to sell or attempt to sell any Commodity:(1)By means of any outcry, sound, speaker or amplifier, or any instrument, or device which can be heard for a distance greater than three hundred feet;...(3)Within 100 feet of any driveway entrance to a police or fire station;(4)Within 500 feet of any Street intersection or pedestrian crosswalk;...(6)Within 500 feet of another vending location assigned to another vendor on a public Street;(7)Within 1,000 feet of a public park;...(9)Within 1,000 feet of a hospital, college, university, elementary school, middle school or high school;...(12)(b)For the period beginning March 1, 2009 and thereafter: Within any areas other than those designated as C-3 (General Commercial); or IN (Industrial) on the Official Zoning Map for the City, as the same may be amended from time to time.

020. Vendors cannot use an outcry, speaker or amplifier audible beyond 300 feet, or use fluttering or spinning devices that distract drivers. Minimum distances apply throughout the City: 100 feet from any police or fire station driveway, 500 feet from any street intersection or pedestrian crosswalk, 150 feet from any driveway, loading zone or taxi stop, 500 feet from another vendor's assigned location on a public street, 1,000 feet from a public park, 150 feet from a building entrance (500 feet for a hotel or motel entrance), and 1,000 feet from a hospital, college, university, elementary, middle or high school.
040(A)(12)(b) limits vending to the C-3 (General Commercial) and IN (Industrial) districts on the Official Zoning Map, a narrowing from the broader C-1, MU-DT, C-3 and IN districts allowed before that date. Signage used by a vendor must also comply with Section 10 of the Unified Development Code. 00 fee.
Violations & Fines
Vending in a prohibited location is treated the same as vending without a permit at all: a Class C misdemeanor under Section 6.50.070, with possible impoundment of the vending vehicle, and grounds for suspension or revocation of the permit under Section 6.50.075(A)(4) for operating contrary to the chapter's location restrictions.
