North Hempstead, NY Food Trucks & Mobile Vendors: Vending Zones (2026)

Section 40-10C bars any peddler, which includes a licensed food vending vehicle under the chapter's definitions, from vending or selling within 200 feet of any church or place of worship, or any place used exclusively as a public or private school, and separately bars parking a cart, wagon or vehicle on a public highway within that same 200-foot buffer. That geographic limit sits alongside § 40-9's rule that no peddler has an exclusive right to any location in a public place and cannot operate in a congested area, and § 40-10D, which bars a solicitor from soliciting business at the scene of any accident within the unincorporated Town.

Because the code has no separate zoning map or list of approved vending locations for food trucks, these distance and congestion rules in Chapter 40 are the only geographic constraints on where a mobile food vendor can legally set up on Town streets. A licensed peddling vehicle must display its Town plate at all times (§ 40-6B), and any Nassau County police officer can stop a vendor to check for a valid license and enforce these buffers (§ 40-15).
