Summary

North Hempstead's Industrial B District performance standards cap noise at 70 decibels beyond the property line, tightening to 60 decibels at a residential boundary when the use sits within 200 feet of a residential district, under § 70-189.2B. Sound attenuation walls are the code's named fix for meeting the limit.

B. Noise. Except where otherwise specified in this chapter, ... all noise shall be muffled so as not to be objectionable, and shall comply with the following: (1) Sound attenuation walls are required to prevent noise levels from exceeding 70 decibels beyond property lines. (2) When located within 200 feet of a residential district or use, sound attenuation walls are required to prevent noise levels from exceeding 70 decibels beyond property lines and no more than 60 decibels at the boundary of the nearest residential use or district.

Full Breakdown

2B treats noise as one of the performance standards every Industrial B use must meet, alongside vibration, air pollution, odors, glare and electromagnetic radiation. The base rule requires sound attenuation walls wherever needed to keep noise under 70 decibels measured beyond the property line; when the use sits within 200 feet of a residential district or use, the code tightens the standard further, requiring the same 70-decibel limit at the property line plus a stricter 60-decibel ceiling measured at the boundary of the nearest residential use or district.

The rule exempts construction activity performed under an approved building permit and complying with federal, state and local law, and it doesn't apply to intermittent noise from safety devices and alarms. Subsection K makes the standard binding on all uses in the Industrial B Zoning District, including existing uses, and a building-permit or certificate-of-occupancy application for a use subject to these standards has to describe the mechanisms used to control noise and other listed impacts, backed by a signed compliance affidavit. The Board of Zoning and Appeals can modify the decibel limits only if the operator shows the standard is impracticable given a specific federal or state noise standard the use already meets, or that modification is necessary for the use's commercial viability, and in either case that neighboring land uses won't be adversely affected.

Violations & Fines

A noise violation isn't priced individually in § 70-235, so it lands in the general § 70-235K schedule: up to $1,000 for a first offense, $1,000 to $2,500 for a second within five years, and $2,500 to $10,000 or up to 15 days in jail for a third, with each week of a continuing violation counted separately.

Frequently Asked Questions

What's the noise limit for industrial property in North Hempstead?
Section 70-189.2B caps noise from an Industrial B use at 70 decibels measured beyond the property line, using sound attenuation walls if needed to hold the line.
Is the noise limit stricter near homes?
Yes. If the industrial use sits within 200 feet of a residential district or use, the code adds a 60-decibel ceiling at the boundary of that residential use on top of the 70-decibel property-line limit.
Can an industrial operator get out of the decibel limit?
Only through the Board of Zoning and Appeals, and only by showing the limit is impracticable against a specific federal or state noise standard the use already meets, or that a modification is needed for commercial viability, without harming neighboring land uses.
