North Hempstead, NY Noise Ordinances: Quiet Hours (2026)

Town Code § 38-3B(1)(a)[1] sets North Hempstead's core nighttime quiet-hours rule: operating or playing a radio, television, phonograph, drum, musical instrument, sound amplifier or similar device between 10:00 p.m. and 8:00 a.m. in a manner that creates a "noise disruption" across a real property boundary or inside a designated noise-sensitive zone is a violation. "Noise disruption" is defined in § 38-2 as sound that interferes with the reasonable and normal activities of a reasonable person of normal sensitivities occupying an area near the source, so the standard turns on actual impact on neighbors rather than a fixed decibel number for this category.

The 10:00 p.m. to 8:00 a.m. window recurs throughout Chapter 38 as the Town's default nighttime boundary: loudspeaker and public address use is barred in that window under § 38-3B(2), loading and unloading noise under § 38-3B(5), and commercial equipment such as air-conditioning and refrigeration systems under § 38-3B(6). Construction noise runs on a stricter 6:00 p.m.-to-7:30-a.m. weekday curfew under § 38-3B(7), and domestic power tools and leaf blowers are barred even later into the morning and earlier in the evening under §§ 38-3B(16) and (18). Whether any given nighttime sound rises to a violation is judged under the factors in § 38-3A(2): volume, proximity to sleeping areas, duration, and whether the sound is recurrent or intermittent.
