090 requires every mobile vendor to hold a mobile vending permit specifying where and when they may operate. Vendors using public or private property such as a vacant or parking lot must maintain an agreement with the property owner, either through the mobile location agreement completed for their Benton-Franklin Health District permit or a notarized written authorization from the property owner. For public-space vending, vendors may be permitted to use one or more parking spaces, sidewalk areas, park areas, or other public ways, with the specific area and vending hours listed on the permit.

The section bars vending within bus stops, loading areas, or ADA parking spaces; within 5 feet of an alley or driveway apron; within 15 feet of a fire hydrant; or anywhere that would inhibit the operation, maintenance, visibility, or functionality of utilities or street fixtures. Route vendors who move more frequently register their typical route with the Benton-Franklin Health District rather than a fixed location, and both they and permitted vendors operating outside their specified permit area must follow the same restrictions. 090(4) states that the regular use of public ways and public or private lots for vending is intended for commercial and industrial areas where people work and frequent businesses, so mobile vending permits for public ways or public/private lots will not be issued for locations in residential areas.
