Chapter 317, Article I, sorts street vendors into fixed and mobile peddlers and caps each group. Section 317-2.5 limits the total number of peddler licenses in the City of Perth Amboy to thirty (30).

Fixed sites. Under § 317-2.3 fixed peddlers are permitted at Washington Park (limit two), Rudyk Park (limit two), Caledonia Park (limit one), Patten Center (limit one), Chamberlain Avenue Field (limit 2), Sadowski Park (limit two) and the Train Station, within a cap of eleven (11) fixed peddler licenses. The Chief of Police or designee decides exact placement on demonstrable public safety criteria. Separately, § 317-2.1 caps the Marina, Sadowski Park and Train Station licenses at six (6) in total and never more than three (3) vendors at any one of those locations; those licenses go to competitive public bidding under the City Purchasing Agent and Business Administrator and carry a three (3) year lease. One grandfathered fixed exception at the corner of New Brunswick Avenue and Fayette Street survives under § 317-2.2, renewable annually, not transferable, and ending after a break in service of twelve (12) months.

Mobile vending. Under § 317-2.4 the City issues at most fourteen (14) mobile peddler licenses. A vehicle or cart cannot stay stationary and must move every fifteen (15) minutes. No person, vehicle or cart can stand or park to sell within 200 feet of the nearest public, parochial or private school or house of worship during school hours or hours of religious services, and school hours run 7:30 a.m. to 5:30 p.m. on weekdays when schools are in session. Mobile peddlers must also keep a distance of not less than a one (1) block radius from any fixed peddler, and the six named avenues and streets are off limits for their entire length.

Section 317-18 sets hours of operation at 5:00 a.m. to 7:00 p.m. and prohibits foot peddlers within the City limits. Under § 317-9, licensees other than the Train Station and the grandfathered corner cannot begin before March 1 or operate past October 31.
