Chapter 259 requires a permit for every garage, yard, tag, lawn, attic, patio, rummage, backyard or basement sale, and Section 259-2 requires the applicant to state the sale location and dates plus any past sale dates, so the City Clerk can track frequency. Under Section 259-4, that same address may not receive a permit for more than two sales in one calendar year, regardless of who applies. for a sale in any other zone, with a residential sale capped at three consecutive days. If rain interrupts a sale before it has run five consecutive hours, the permit holder may reschedule that day within 14 days of the canceled date, but must notify the City Clerk of the new date within 72 hours under Section 259-5B.

During the sale, the permit holder may not add goods beyond what was in their possession before the sale began, may not acquire new merchandise for resale, and must keep the permit displayed on the premises the entire time. If the permit holder decides not to hold the sale after all, Section 259-2D bars any refund of the permit fee. The chapter's exemption in Section 259-6 removes any sale ordered by a court from these limits entirely.
