Greece, NY Garage & Yard Sales: Frequency, Duration & Permits (2026)

Chapter 163A, Secondhand Dealers, exists to license anyone buying used goods commercially in the Town, and its definitions section carves out an exemption for casual private sales. Under § 163A-1(C)(2), a garage sale, basement sale, porch sale, yard sale or similar event where a person sells or trades personal used items, household goods or furniture from their own premises falls outside the secondhand dealer definition entirely, so long as the same person or persons do not hold more than three such sales on the same premises within one calendar year, and no single sale runs longer than 10 consecutive days.

Exceed either limit and the activity is treated as unlicensed secondhand dealing, which under § 163A-3 requires a Town Clerk license, a Police Department background investigation under § 163A-4, and a $10,000 bond under § 163A-14 before any further sales can lawfully continue. The Town's property maintenance chapter separately addresses the physical signage used to advertise these sales: § 157-9 lists 'garage sale' signs among temporary signs that must conform to the size and placement standards of that section and be removed within 48 hours of the end of the event.

Because the frequency cap lives in the definitions of the licensing chapter rather than as a standalone permit requirement, no garage sale permit or application is needed in Greece as long as a resident stays within the three-sales, 10-day-per-sale ceiling; residents who want to hold a fourth sale in a year, or run one longer than 10 days, need to look at whether they now qualify as a secondhand dealer under the licensing chapter.
