Sec. 30(1) of the City of Milton zoning ordinance defines a 'garage or estate sale (auction)' as a temporary display of used household goods on a residential property that does not exceed four days in duration and occurs no more than three times in a 12-month period, also known as a rummage or yard sale. ' The code itself is not internally consistent on the annual number, three in the definition versus four in the operating rule, so anyone planning multiple sales in a year should confirm the current interpretation with the zoning administrator before scheduling a fourth sale.

What is consistent across both provisions is the four-day maximum per sale and the requirement that whoever runs the sale actually reside at the property. No permit is required for a garage or estate sale under this section, and sales are further limited to daylight hours. Signage for the sale is addressed separately: right-of-way placement is barred, and the sign has to comply with the general sign code in Article IX. Because the temporary use provisions of Sec. 40 apply to garage sales except where this section states otherwise, a sale that runs longer than four days, or that is really a recurring retail operation, can be treated as exceeding the temporary-use standard.
