Newark, OH Garage & Yard Sales: Frequency, Duration & Permits (2026)

Chapter 836 of the Newark Code of Ordinances regulates home sales, defined in Section 836.01 as sales of tangible personal property on residential property, including garage, patio, yard, carport, basement, porch and driveway sales. Under Section 836.02, businesses located in residential areas and auction sales under Chapter 816 fall outside the chapter. Section 836.03 requires a permit from the Director of Public Service or a designee before any home sale, and a separate street sale permit, listing every participating address on the street, before any street sale.

Section 836.05 sets the frequency and duration limits. A home sale permit costs $5.00 and is valid for not more than five consecutive calendar days. It goes only to an adult living at the sale location, or, for an estate sale, to the personal representative or an adult heir of the decedent. No permit issues for any one location more than twice in any 365-day period, and that count includes both home sale permits and participation in a street sale. A home sale cannot be held at any property other than the applicant's residence. A street sale permit costs $10.00, lasts no more than two consecutive calendar days, and goes to an adult who lives on the street or who is helping organize a neighborhood sale.

The application under Section 836.04 lists the applicant's name and residence address, the sale address, the sale dates, and a general description of the property to be sold, plus a signed acknowledgment of the chapter. Section 836.07 prohibits starting before 9:00 a.m. or running past 8:00 p.m. on any permitted day, and the Director of Public Service can prescribe narrower hours. Section 836.08 requires the permit to be posted in a prominent place on the premises for the entire sale. Merchandise bought for resale cannot be offered, and any new merchandise is prima-facie evidence of resale stock.
