Chapter 234 licenses every garage, yard, porch and house sale held on residential property in Passaic. Under § 234-2, a City Clerk-issued license is required before any goods can be advertised or offered for sale in one of these formats, and a denial can be appealed to the City Council by written petition within five days. Section 234-4 sets the licensing period itself: the license authorizes the sale described in the application for not more than three days within a thirty-day period, except for house sales, which may run for up to seven days within a thirty-day period, matched by § 234-5, which allows house sales to run either seven consecutive days or three consecutive days on each of two consecutive weekends.

The license authorizes only the one type of sale named in the application at the location named, and it cannot be assigned or transferred to another person or address (§ 234-5). Applicants must disclose the owner of the goods, the sale location, whether the applicant owns or rents the property, the sale dates including rain dates, and the hours of sale. A license also cannot be issued again for the same location for 90 days after a prior sale under § 234-3, so the three-or-seven-day window cannot simply be repeated back-to-back at one address. , and must keep goods and signage off the public right-of-way.
