A. 6, adopted by Ordinance No. 2172-18 in 2018, creates Passaic's local permit mechanism for the exception. The City Clerk may issue a driveway owner, or, for a private residence, any household member who owns a vehicle, up to three permits authorizing a private passenger vehicle to park in front of that owner's own driveway. Applicants must show the driveway was legally established under the municipal Zoning Code. The permit measures five and one-half by eight and one-half inches, must carry a certification of authenticity, and must be displayed prominently in the vehicle, visible from the middle of the street.
6C makes it an affirmative defense to a § 39:4-138(d) prosecution if the parked vehicle and the driveway belong to the same person, to the same household, or if the driveway owner authorized the parking; that defense can be raised by affidavit under Court Rule 7:6-6(a), and the permit's rights override any other City parking-permit rule. No owner may allow a vehicle to park in front of the driveway without a valid permit displayed, and no owner may charge a fee for granting that permission.
The parked vehicle must sit parallel to the curb and must not block sidewalk access, and any pavement markings for the driveway may extend no further than the minimum clearance needed to safely enter and exit. 6H.
