Chapter 771 defines a "garage sale" broadly under Section 771.01 to include any general sale open to the public from a residential premises to dispose of personal property, whatever it is called (garage, lawn, yard, attic, porch, room, backyard, patio, flea market, or rummage sale), but excludes a listing for a single titled vehicle that is specifically named in all advertising. "Personal property" is limited to property an individual or household member owns and uses in the normal course of residing there, excluding merchandise bought for resale or held on consignment.

Section 771.02 restricts sales authorized under the chapter to personal property only, not resale merchandise. Section 771.07 sets the operating limits: sales may run only between 8:00 a.m. and 6:00 p.m., for three consecutive days, and no more than two such sales may be held at any individual residence or by any family household during a calendar year. A garage sale found violating the chapter, or any other applicable law, may be closed on inspection by the Business Licensing Officer or another responsible enforcement official under Section 771.12.

Section 771.14 exempts court-ordered sales and sales conducted by public officials acting within their duties. Section 771.15 makes every sale of an article and every day a sale runs in violation of the chapter a separate offense, and Section 771.16 authorizes the Community Development Director to issue citation tags to inspectors for giving notice of violations.
