Tustin, CA Garage & Yard Sales: Frequency, Duration & Permits (2026)

Tustin City Code § 3552 limits garage sales at the same address to four occurrences in any calendar year, with a single sale lasting no more than three consecutive days. No City permit or fee is required. Section 3551 restricts what can be sold: only personal property accumulated for personal use by the resident conducting the sale. Craft items the resident manufactured, items bought specifically for resale, and retail sales of new merchandise are all prohibited, and the sale cannot spill onto public sidewalks, parkways, streets, alleys or other public property.

Section 3554 gives the City the right to inspect all property offered for sale at the location where the sale is held. Signs advertising the sale are addressed separately in Section 3553, which requires compliance with the Sign Code and removal by sunset on the last day of the sale. Because Chapter 5, Part 5 does not carry its own fine schedule, a garage sale that runs longer than three days, occurs a fifth time in a calendar year at the same address, or sells prohibited merchandise is enforced under the Code's general penalty at Section 1121: an infraction citation runs $100 for a first violation, $200 for a second within a year and $500 for each violation after that, or the City Attorney may instead charge it as a misdemeanor punishable by up to $1,000 or six months in the Orange County jail.
