HOA architectural review must follow Civil Code 4765, which requires written procedures, good-faith decisions, and cannot forbid protected changes such as solar panels under Civil Code 714.
HOAs within Palo Alto must apply architectural review under California Civil Code 4765, which requires that the association provide a fair, reasonable, and written procedure for reviewing member applications. Decisions must be made in good faith, cannot be arbitrary or capricious, and must be delivered in writing. If an application is denied, the member has the right to request a hearing with the board. HOAs cannot enforce restrictions that unreasonably prohibit solar energy systems under Civil Code 714, or that prevent reasonable accommodations for disabilities, EV charging stations (Civil Code 4745), or drought-tolerant landscaping. Architectural review decisions are separate from Palo Alto building permits; owners may still need a city permit for work approved by the HOA, and city approval does not override HOA requirements.
