Mansfield HOA boards follow TX Property Code 209 (POA Act): open meetings, 10-day annual notice, owner record inspection, and fiduciary duties. SB 1588 (2021) adds online CCR posting for 60+ lot HOAs.
Homeowners associations in Mansfield master-planned communities such as South Pointe, Walnut Creek, Mansfield National, and The Reserve at South Pointe operate under TX Property Code Chapter 209, the Texas Residential Property Owners Protection Act. Boards must hold regular meetings with advance written notice to all members, keep accurate minutes, and allow owners to inspect books and records within 10 business days of a written request under Section 209.005. The annual meeting requires at least 10 days notice with agenda under Section 209.0057. Section 209.00592 requires boards to be elected by a secret ballot vote of members when contested. SB 1588 (87th Legislature, 2021) amended Chapter 209 to require associations with 60 or more lots to post dedication documents (CCRs, bylaws, rules) on a public website, to give owners greater notice rights for fines and foreclosure, and to cap late fee compounding. Board members owe fiduciary duties to the association, must act in good faith and with the care of an ordinarily prudent person, and may not receive undisclosed compensation or benefits. Conflicts of interest must be disclosed in minutes. Owners can sue for violations of Chapter 209 including injunctive relief and attorney fees.
POA Act violation: owner lawsuit for injunctive relief. Failed website posting (60+ lots): statutory penalty. Records inspection denial: damages plus fees.
