Summary

Aurora, Colorado lets HOAs impose stricter limits than the city code, and the city's own chicken-keeping ordinance says so explicitly.

Nothing herein shall be construed to permit the keeping of chickens or ducks upon any property when such activity is otherwise prohibited by covenants, conditions, and restrictions imposed by a homeowners' association with respect to such property.

(f) It shall be unlawful for a person to keep or allow to be kept a rooster or roosters on any lot of single-family residential property anywhere in the city. Any person who enters a plea of guilty or no contest or is convicted of violating this subsection shall be subject to the penalty provisions as provided in section 1-13. (Ord. No. 2022-48, § 1, 9-12-2022; Ord. No. 2020-55, § 35, 11-2-2020; Ord. No. 2015-60, § 1, 12-7-2015; Ord. No. 2014-06, § 1, 2-24-2014)

Full Breakdown

Aurora's city code permits keeping chicken hens and ducks under a housing department permit, but Sec. 14-134(e) expressly carves out HOA authority: the city permit does not override a homeowners' association's covenants, conditions, and restrictions (CC&Rs) that prohibit the activity. If an Aurora HOA's CC&Rs ban backyard poultry, that private contract controls on that property even though the city code allows it citywide. The city permit and the HOA's CC&Rs are separate, independently enforced layers.

Violations & Fines

City enforcement: code violations (e.g., no permit, roosters, coop setback) draw penalties under Sec. 1-13 and possible permit revocation. HOA enforcement of CC&R violations is separate, civil, and pursued by the association, not the city.

Frequently Asked Questions

Does an Aurora chicken permit override my HOA's rules?
No. City Code § 14-134(e) states the permit does not authorize keeping chickens or ducks where an HOA's CC&Rs prohibit it on that property.
Who enforces HOA restrictions in Aurora, Colorado?
The homeowners' association enforces its own CC&Rs civilly; the city separately enforces its own code sections like permit and coop requirements.
