Summary

DuPage County's zoning ordinance doesn't cancel out your subdivision's recorded covenants, but the County won't enforce your HOA's CC&Rs either: if the zoning ordinance is stricter than the covenant, the zoning ordinance controls, per Section 37-401.4.

Section 37-401.4 (Existing Agreements) of the County Zoning Ordinance says the chapter "is not intended to abrogate any easement, covenant, or any other private agreement": your subdivision's CC&Rs stay legally valid, and enforcing them is still a civil matter between you and the homeowners association, not something DuPage County's code enforcement staff handle. But the provision cuts the other way too: wherever the zoning ordinance's own permit, use, or dimensional standards impose a higher requirement than the private covenant does, the County's zoning rules govern for zoning-compliance purposes, not the HOA agreement.
