Texas Property Code Chapter 209 requires due process before an HOA may levy fines, including notice of the violation and an opportunity for a hearing. Section 202.004(c) authorizes a civil penalty of up to $200 per day for covenant violations recoverable only through court action. City Code Compliance handles public ordinance violations, not private deed restrictions.
HOAs may impose fines, record liens for unpaid amounts, or sue for injunctive relief. The City will not cite owners for CC&R violations that do not also violate a public ordinance.
