Summary

The Village of Hamburg does not enforce or maintain a record of private agreements, and its Zoning Chapter does not annul any easement, covenant, deed restriction or other agreement between private parties. Where the zoning chapter imposes a greater restriction than a private agreement, the zoning chapter controls under § 250-10.6B. Where the two differ, the most restrictive standard governs.

§ 250-10.6. Conflict with other regulations. A. In their interpretation and application, the provisions of this chapter shall be held to be the minimum requirements adopted for the promotion of the public health, community values, safety, or other general welfare. Whenever the requirements of this chapter are at variance with the requirements of any other applicable law, ordinance, regulation, or private agreement, the most restrictive, or that imposing the higher standards, shall govern. B. The Village does not enforce or maintain a record of private agreements. This Zoning Chapter is not intended to interfere with, abrogate or annul any easement, covenant, deed restriction or other agreement between private parties. If the provisions of this Zoning Chapter impose a greater restriction than imposed by a private agreement, the provisions of this Zoning Chapter will control.

Full Breakdown

Section 250-10.6 of the Village of Hamburg Zoning Law, adopted by the Board of Trustees in L.L. No. 1-2022 and effective March 23, 2022 under § 250-10.7, draws the line between village zoning and private covenants. Subsection A treats the chapter's provisions as the minimum requirements adopted for the promotion of the public health, community values, safety, or other general welfare. When the chapter is at variance with any other applicable law, ordinance, regulation or private agreement, the most restrictive, or the one imposing the higher standards, governs.

Subsection B limits the village's role. The Village does not enforce or maintain a record of private agreements. The chapter is not intended to interfere with, abrogate or annul any easement, covenant, deed restriction or other agreement between private parties. If the zoning chapter imposes a greater restriction than a private agreement, the zoning chapter controls.

That creates two separate tracks in the Village of Hamburg. Zoning violations are handled by the Code Enforcement Officer under § 250-18.2: the CEO serves a written notice of violation and correction order stating the violation, the remedy ordered and a time limit, and the notice must tell the violator of the right to appeal the CEO's interpretation to the ZBA. Unless the chapter sets a different time limit, the notice gives 30 days to correct. Complaints go in writing to the Building Inspector under § 250-18.3. Association covenants, deed restrictions and easements sit outside that process because the village keeps no record of them and does not enforce them.

The practical result is that a private agreement cannot excuse a zoning violation, and a village permit does not settle a covenant question. A covenant that asks for more than village zoning is not displaced by the zoning chapter, and a covenant that allows more than the zoning chapter does not override it.

Violations & Fines

A violation of the Zoning Chapter is an offense under § 250-18.2C: a fine not exceeding $250 or imprisonment not to exceed 15 days, or both, for a first offense; a fine of $250 to $700 for a second offense within five years; and $700 to $1,000 for a third or later offense within five years. The Village does not enforce private agreements under § 250-10.6B, so covenant disputes sit outside this penalty scheme.

Frequently Asked Questions

Will the Village of Hamburg enforce my HOA's covenants?
No. Section 250-10.6B states that the Village does not enforce or maintain a record of private agreements. An easement, covenant, deed restriction or other agreement between private parties is a matter for those parties. The village keeps no file of them, so the zoning office cannot confirm what a given covenant says.
What happens if my HOA rule is stricter than village zoning?
Under § 250-10.6A, when the zoning chapter is at variance with any other applicable law, ordinance, regulation or private agreement, the most restrictive, or the one imposing the higher standards, governs. The chapter is a minimum, and § 250-10.6B says it is not intended to annul any covenant or deed restriction.
What if the village zoning rule is stricter than my covenants?
The zoning chapter controls. Section 250-10.6B says that if the chapter imposes a greater restriction than a private agreement, the provisions of the zoning chapter control. A covenant that permits more does not excuse a zoning violation, and the Code Enforcement Officer can serve a notice of violation under § 250-18.2.
