Texas Property Code ยง209.007 requires Frisco HOAs to offer a hearing before levying fines or suspending rights, and ยง209.0051 requires enforcement policies be adopted and recorded. Owners can request ADR and sue in Collin County district/JP court for declaratory relief.
Before an HOA can fine or suspend use of common areas, ยง209.007 requires written notice identifying the violation, a 30-day cure period where the violation is curable, and a hearing right before the board. Hearings must be scheduled within a reasonable time and recorded if the owner requests. ยง209.0051 requires boards to adopt written enforcement policies including schedule of fines. Owners may file in Collin County JP court for disputes under $20,000 or district court for larger claims or injunctive relief. Texas does not mandate pre-suit mediation but many CCRs do; ยง209.0052 allows agreed binding arbitration.
Fines or suspensions without notice/hearing are void; owner can recover attorneys fees under ยง209.008.
