FL ยง720.311 requires parties to attempt pre-suit mediation for covenant enforcement disputes, amendments, meeting noticing, and board elections. Mediation is conducted by a Florida Supreme Court certified mediator. If mediation fails, parties may proceed to circuit court. Collection actions, emergency injunctions, and title disputes are exempt. HB 919 (2023) expanded DBPR investigative authority but most enforcement still requires civil action. Prevailing party entitled to attorney fees under FL ยง720.305(1).
