California's Homemade Food Act lets Bostonia residents make and sell nonpotentially hazardous 'cottage foods' from their home kitchen. You need a County cottage food registration or permit from the Department of Environmental Health & Quality, and the use must fit the Section 6156 home-occupation rules.
The California Homemade Food Act (Health & Safety Code section 113758) defines cottage food products as nonpotentially hazardous foods prepared for sale in the kitchen of a cottage food operation. Class A operators may make direct sales; Class B may make direct and indirect sales, within annual gross-sales limits. In unincorporated San Diego County, the Department of Environmental Health & Quality (DEHQ) registers Class A and permits Class B operations, and the County Zoning Ordinance 6156 recognizes an approved cottage food operation as the exception to the no-on-premises-sales rule for home occupations.
Selling cottage foods without the required DEHQ registration/permit is a violation of the Homemade Food Act and County code, subject to enforcement and closure.
