Framingham, MA Home Business: Customer Traffic Restrictions (2026)

Section 435-9D of the Code of the City of Framingham caps in-person client traffic for any home occupation operating out of a single-family dwelling. At no point may more than three customers, clients, pupils, or patients be present on the property simultaneously, whether they are there for retail purchase, personal services, tutoring, or in-home treatment. The subsection also fixes an operating window: client visits are allowed only between 8:00 a.m. and 9:00 p.m., and only Monday through Saturday, which means the home occupation cannot receive visiting customers on Sundays under any circumstances.

This limit sits alongside the other § 435-9 conditions covering floor area, employees, and signage, all of which the Building Commissioner and Inspectional Services Division enforce as ordinary zoning compliance rather than through a separate business license. Because § 435-9A requires the home occupation to remain clearly incidental and secondary to the residential use of the dwelling, a pattern of exceeding the three-visitor cap or receiving clients outside the permitted hours does more than break subsection D in isolation, it undercuts the basic finding that the use is staying secondary to the home's residential character.

A home-based tutor, hairstylist, therapist, or similar service business that regularly hosts four or more people at once, or that takes appointments before 8:00 a.m., after 9:00 p.m., or on Sundays, is operating outside the scope of the accessory use the zoning ordinance authorizes, and the City can require the schedule or occupancy to be brought back into compliance before the use continues.
