A Las Cruces home occupation must keep customer traffic minimal. Sales and services are by appointment only, with no more than one customer vehicle at the dwelling at a time and no more than two customer vehicles per hour. Off-the-shelf retail sales are banned; deliveries are capped by truck size.
Section 38-52 regulates the traffic a home business generates. There is no direct sale of products off display shelves; retail sales happen only on orders placed by phone, mail, computer, or at a sales party, and service must be by appointment so only one customer vehicle is at the dwelling at a time. Under the parking rules, no more than two customer vehicles per hour may frequent a home occupation, except for instructional service, babysitting, and child care. Deliveries are capped at two per week from a two-axle vehicle and one per month from a three-axle vehicle; four-or-more-axle trucks are prohibited, and business vehicles over one ton may not park at the residence or on the street.
Generating heavy customer traffic, running walk-in retail sales, or exceeding the delivery limits violates the home occupation standards. Codes Enforcement can revoke the registration and cite a petty misdemeanor, with fines up to $500 or 90 days in jail.
