Casper's zoning code splits home-based child care into tiers by headcount. A "family child care home" caring for three to eight unrelated children from more than one family is a permitted use outright in the R-1, R-2 and AG districts. Once a provider takes on nine or ten children, the use becomes a "family child care home - zoning review," and a facility for up to fifteen children becomes a "family child care center - zoning review"; both require a conditional use hearing before the Planning and Zoning Commission in residential districts under § 17.12.240(M).

That section spells out day-care-specific standards on top of the normal conditional use procedure: the outdoor play area must be fenced, the day care use must stay clearly incidental and secondary to the home's residential character and not change the neighborhood, care must not create a nuisance, the Casper Fire Department must approve the zoning-review-tier facilities, and providers must supply off-street parking as required by § 17.12.080, where item 19 sets two spaces for a group day-care home, which can be the same two spaces already required for the residential dwelling.

A day-care conditional use permit is issued to the specific provider, not the land, and is not transferable to a new operator or new address without a fresh application; renewal is otherwise automatic unless the play yard changes or a neighbor files a property-related complaint.
