Casper, WY Noise Ordinances: Construction Hours (2026)

Casper Municipal Code § 8.20.030 lists the activities exempt from the city's general noise-level regulations, and subsection D covers construction: noise from commercial or residential building repair, maintenance or construction, grounds construction or maintenance, and excavation and construction on streets and highways is exempt from the noise limits only between seven a.m. and nine p.m. Within that window, the exemption applies to tools and equipment used in construction, drilling, earthmoving, maintenance or demolition, but only if the equipment functions as the manufacturer designed it and every piece of motorized equipment is fitted with a working muffler; a contractor running unmuffled or malfunctioning equipment loses the exemption even during permitted hours.

Work outside the seven a.m. to nine p.m. window is not automatically illegal, but it is not exempt either: Section 8.20.030(D)(2) requires the contractor to obtain a special permit under Section 8.20.060 before running construction noise between nine p.m. and seven a.m. The city manager grants that permit on a showing of undue hardship, a temporary activity that cannot otherwise comply, or the lack of a reasonable alternative, and may attach conditions to protect the surrounding neighborhood. Construction noise that exceeds these bounds is treated the same as any other noise violation: it is a misdemeanor under Chapter 1.28's general penalty provisions per Section 8.20.070, with each day of the violation a separate offense, and it can also be abated as a public nuisance under Section 8.20.080.
