East Orange's Land Use Code does not carve out a separate zoning category for small in-home child care; instead, § 51-5 defines 'FAMILY DAY-CARE HOME' directly as a home occupation, meaning the use is folded into the home-occupation standards of § 51-122 rather than the larger conditional-use track that governs standalone child-care centers under § 51-138. The definition itself sets the size and hours that qualify: the home must be approved by the Division of Youth and Family Services, or run through an organization under DYFS contract, and it can serve no fewer than three and no more than five children for at least 15 hours a week.

Because the ordinance classifies the use as a home occupation, it inherits § 51-122's constraints on the property: the care must be conducted entirely inside the principal dwelling, it cannot use more than 25% of the dwelling's gross floor area, only one outside employee beyond the resident family may work in it, and any exterior sign is limited to a one-square-foot nameplate. A larger operation, one that exceeds five children or runs as a freestanding facility rather than inside a private residence, falls out of the 'family day-care home' definition entirely and instead has to meet the separate conditional-use standards for child-care centers in § 51-138, which impose their own minimum lot size, setbacks and an on-site queuing area for at least four cars.
